Attorney Kotzas Speaks on Site Remediation Reform Act
Toms River, NJ – Stephen B. Kotzas, Esq. spoke on New Jersey’s Site Remediation Reform Act and the effect it will have on the area at a seminar to the business community. The act, signed by the Governor on May 7, 2009, removes the responsibility for the clean up of contaminated sites from the NJ Department of Environmental Protection and into the hands of independent licensed professionals.
The new rules began to be phased in as of November 4, 2009 and will take full effect in May, 2012. In essence, the act privatizes the clean up function, while at the same time dramatically reducing the required timetables for such clean ups to be completed. The statute has significant implications for the legal and financial obligations of individual and business owners of contaminated sites. According to Kotzas, “There are approximately 24,000 such sites in the state and the new legislation will accelerate their clean up."
